Every newborn deserves the same protection under Australian law.

Every week, an Australian baby is born alive following an abortion and may be left without a clear legal right to life-sustaining treatment or medically appropriate palliative care.

This is not hypothetical. Official health data and reported cases document hundreds of babies born alive following failed abortions across Australia, including 418 in Queensland, 426 in Victoria, 6 in the NT and 27 in Western Australia.

Yet only NSW and South Australia currently have specific legislative protections addressing babies born alive following abortion.

Llew O'Brien's new bill, the Human Rights (Children Born Alive Protection) Bill 2026 would establish a national standard of birth equality, ensuring that every Australian newborn is entitled to appropriate medical care and protection, regardless of how they came to be born.

No baby should be denied care because they survived an abortion.

Dear Prime-Minister Albanese,

We call on the Labor government urgently pass the Human Rights (Children Born Alive Protection) Bill 2026. 

This bill seeks to guarantee birth equality in Australia by ensuring that every Australian newborn is treated equally under the law.

We are appalled that only NSW and South Australia have specific legislative protection for newborn abortion survivors.

Every week an Australian newborn survives an abortion and is left to die in a jurisdiction without a legal right to palliative care or life-sustaining treatment, whichever may be medically appropriate.

We urge the swift passage of this Act through the parliament to ensure the human rights of all newborns are safeguarded in Australia.
